Mallinckrodt Is Reluctant To Try To Withdraw Acthar’s Antitrust Complaints

By Rick Archer (December 17, 2021, 9:12 p.m. EST) – Mallinckrodt opposed a request by Acthar’s antitrust claimants to withdraw their Chapter 11 claims, telling a Delaware bankruptcy judge on Friday that he needed a claims ruling to secure a post-bankruptcy distribution agreement.

In a virtual hearing, attorney for Acthar’s claimants told U.S. bankruptcy judge John Dorsey that their clients no longer think their claims are worth pursuing, while Mallinckrodt said allowing applicants to withdraw would jeopardize an adversarial process which the company must move forward on.
